INSTRUCTIONS FOR STANDARD CONSTRUCTION CONTRACT

(For Use Where Construction is on Contractor’s Property)

This contract is a template or a “suggested standardized agreement form” covering the building transaction for use between the builder and a customer, “where construction is on the contractor’s property.”  A different form (Template A) should be used when improvements are made to property owned by the customer, because there are different provisions, and disclosure requirements mandated by law, applicable in that situation.  

Because this contract is a TEMPLATE, it may be used “as is” or it may be modified to fit different situations or needs.  However, as noted further herein, certain paragraphs are mandated by law and certain paragraphs are intertwined.  Please DO NOT change the paragraphs mandated by law and be careful in any modifications to the contract to be certain that cross-references are not inadvertently deleted or maintained.  In addition, as the WARNING on the contract itself notes, many construction contracts and situations are different.  Therefore, before using this form, each party should consult with independent legal counsel in order to ensure that the contract adequately and accurately describes the particular circumstances and understanding and agreement of the parties.  Be sure to fill in all blanks correctly and completely and attach all applicable exhibits.
