    The First Amendment states “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.”  Although the legal foundation of the American freedom to speak is moderate, sometimes expression may be punished under certain bylines and the government has a legal right to interfere.  For instance the government can stop expression that threatens national security, incite a riot, damages the reputation of others or invade their privacy.  The government and the judgment employed by the court can determine what is not protected under the First Amendment.
    Federal Courts have the power under the Fourteenth Amendment to nullify laws that violate the First Amendment.  Under the content regulations of the First Amendment falls strict scrutiny.  Strict scrutiny ensures that regulations are justified by a compelling government interest and are specified very narrowly.  Strict scrutiny prevents the government from unconstitutionally favoring or discriminating against a subject or viewpoint.  
Freedom of expression offers fulfillment to the nations citizens.  Many scholars have found that freedom of expression promotes liberty and protects the integrity of an individual.   Free expression promotes stability, flexibility, tradition and change as well.  The late Professor Thomas I. Emerson said where there is freedom of expression society is better able to maintain.
