Facts, Regulations and Legal Issues
Alumina is an aluminum manufacturer with an excellent reputation that its CEO is committed to protecting. About five years ago, in the simulation, Alumina was cited by the EPA for a violation related to results of increased polycyclic aromatic hydrocarbons (PAH). Alumina’s response was to address the situation directly and was cleared in the subsequent audit (University of Phoenix, simulation, 2008).
The situation presented first in the simulation is a complaint filed by an individual who believes that Alumina is polluting the water and that pollution caused the leukemia in the complainant’s child. This complaint calls into scrutiny the company’s practices with regard to the Clean Water Act of 1974. This federal law “Directs the EPA to set maximum drinking water contaminant levels for chemicals, pesticides, and microbiological pollutants” (Reed, Shedd, Morehead & Corley, (2004) p.509). Under the provisions of this law, the complainant can hold Alumina responsible for the sickness if she can prove that Alumina is polluting the water in excess of standards set by the EPA for maintaining clean water.
